The website (Swecha’s Angadi) and all other online properties (“Site”) managed by Varma Associates proprietorship, along with our affiliates and subsidiaries (“Swecha’s Angadi,” “we,” or “us”), are subject to these terms and conditions (“Terms”). The terms “User(s),” “you,” or “your” refer to individuals visiting and/or using the Site in any capacity. “Released Parties” encompass Swecha’s Angadi and its officers, employees, agents, partners, and licensors.

Your utilization of the Swecha’s Angadi Site, including the acquisition of any Products, is governed by the following Terms. Please carefully review these Terms. By accessing this Site, you agree to abide by these Terms and any additional terms, guidelines, or rules that are applicable to specific sections of this Site, without limitations or exceptions. We offer the Site to facilitate your exploration and purchase of Swecha’s Angadi products and services (“Products”). The terms “Products” and “Services” are used interchangeably herein and denote the use of the Site for browsing and purchasing Swecha’s Angadi products.

1. Privacy

To gain a comprehensive understanding of how we collect and utilize your information, please consult our privacy policy. This Privacy Policy is expressly integrated into these Terms by reference.

2. Electronic Communication 

By visiting the Site or sending us emails, you engage in electronic communication with us. Whether you place an order as a guest or register on the Site, you are acknowledging acceptance of the Terms. Consequently, you agree to receive communications from us electronically. We will communicate with you through email or by posting notices on this Site. Your agreement acknowledges that all agreements, notices, disclosures, and other communications provided to you electronically fulfill any legal requirement for written communication.

3. Eligibility

While no part of the Site is off-limits or unlawful for individuals under the age of 18 (eighteen) years, if you fall into this age category, you may only use the Site under the supervision of a parent or guardian.

If you are accessing the Site on behalf of someone else, such as your child, you affirm that you are authorized, either explicitly or through implied consent, by the concerned individual to (i) accept these Terms on their behalf and (ii) be bound by these Terms on their behalf.

For users representing a company, entity, or organization (collectively referred to as “Organization”), you confirm that (a) you are an authorized representative of the Organization; (b) you have the authority to bind the Organization to these Terms, and (c) you consent to be bound by these Terms on behalf of the Organization. swecha’s Angadi retains the right to refuse access or use of the Site and its Products to any individual or entity at any time, based on our sole and absolute discretion.

4. Copyright

Images featuring individuals, locations, and/or products showcased on this Site are either owned by Swecha’s Angadi or our licensors. Unless explicitly stated otherwise, all content incorporated into this Site, encompassing images, illustrations, designs, icons, photographs, video clips, written materials, and

other components, including Marks, collectively referred to as “Swecha’s Angadi Content,” is the property of Swecha’s Angadi or its licensors, partners, or affiliates. It is safeguarded by both Indian and international copyright laws. The compilation of this Site holds the exclusive ownership of Swecha’s Angadi and is protected by Indian and international intellectual property laws. Unauthorized use of any content or materials on this Site is strictly prohibited and may contravene copyright and trademark laws, as well as privacy, publicity, and communication regulations and statutes. You are permitted to use the materials or content on this Site only with our prior written and explicit authorization. 5. Trademarks

The intellectual property rights to all trademarks, service marks, and trade names (referred to collectively as the “Marks”) featured on this Site belong to us or the respective owners of such Marks from whom we may have obtained licensing. Without the prior written consent of Swecha’s Angadi, you are not permitted to showcase or replicate the Marks in any way. Additionally, you must refrain from removing or altering any trademark notices from the content accessed or received through the Site.

6. Limited License And Site Access

We provide you with a limited license to use the Site exclusively for personal purposes. However, this license does not authorize you to:

(a) Resell or engage in any commercial use of the Site or its contents.

(b) Modify, adapt, translate, reverse engineer, decompile, disassemble, or convert any content on the Site not intended for human-readable form, including viewing the underlying HTML or other code, except as interpreted and displayed in a web browser.

(c) Copy, imitate, mirror, reproduce, distribute, publish, download, display, perform, post, or transmit any content from the Site (including any Marks) in any form or by any means, whether electronic, mechanical, photocopying, recording or otherwise.  

(d) Utilize any data mining, bots, spiders, automated tools, or similar data gathering and extraction methods on the Site’s content, or collect information from the Site or any other user of the Site.

7. Fees and Payments, Shipping

Prices:

The prices for Products available on the Site will be visible to you during your visit. Any applicable taxes will be communicated before you finalize your order. There is no charge for standard shipping.

Payments:

Currently, the Site utilizes third-party services for payment processing. Our payment processors accept payments through various methods, including credit cards, debit cards, and net banking, as specified on the payment screen. Additionally, you have the option to finance your purchase through different financing institutions, as indicated on the payment screen.

Shipping:

Upon receiving your order confirmation and, in the case of prepaid orders, the payment, the Products will be shipped. When placing an order through the Site, the Products will be shipped to the address you specify as the “Shipping Address” during the check-out process, provided that the location is serviceable by us. You can verify the serviceability of a location by entering the relevant PIN code on the Site. Title and ownership of products remain with us until they are delivered to you at the Shipping Address. Any damage to the product after delivery is your responsibility, and we are not liable for such damage, except as provided in the terms of warranty, returns, and refunds. In the event of loss or damage during delivery due to a fault of  Swecha’s  Angadi or the logistics partner, we will make every effort to collaborate with you and the carrier to recover your shipment or replace the damaged product.

8. Refunds and Returns, Cancellation

Warranty:

Your Swecha’s Angadi Products come with varying warranty periods. If you encounter any issues with your product, please review the warranty conditions associated with each product on the Product Warranty page (“Product Warranty”) and click here to contact us. The Product Warranty is integrated into these Terms by reference. In the event of a conflict between the terms of the Product Warranty and these Terms, the Product Warranty terms will prevail for Products purchased from Swecha’s Angadi.

Returns:

For Products eligible for return as indicated on the product listing page, follow the process detailed below. The time limits for returns or replacements are mentioned on the respective product’s listing page and are incorporated into these Terms by reference. Return shipping within India is free, and you may cancel an order anytime before shipment.

Product Returns:

To initiate a return within the allowed time frame, click here to contact us and arrange a return pick-up.

The following conditions apply to Product returns:

Products must be in donatable condition, with no stains, tears, or other soiling, except for defects reported with the return request and confirmed by our representative. Products shipped outside of India are not eligible for return. Customers may return a maximum of two (2) units of a specific Product per initial order, validated by a customer name or shipping address. For Products eligible for the No-Questions-Asked return policy, such as the 100 day trial for some mattresses, customers, or shipping addresses that return at least one Product type from an initial order will not be eligible for additional 100-night trials on subsequent orders of that particular Product. You may opt for a replacement of the returned product or a refund, as per the Product Warranty. Further details about Replacement and Returns are available in the FAQ’s here

Refund Mode and Duration:

Upon initiating your refund, share your official email address and bank account details with us, upon request through email or other communication. After providing the necessary details, you’ll receive a refund initiation confirmation, and the refunded amount will be credited to your account within 5 working days of us receiving the required information. For cash-on-delivery orders, refunds will not be provided in cash and the amount will be transferred electronically to your bank account, the details of which will be requested in the aforementioned manner.

Out of Stock:

We strive to maintain all listed products in stock for dispatch. If a product is unavailable for any reason, we will contact you to discuss options such as exchange, delay, or cancellation based on your preference. Any refund obtained under this provision will adhere to the specified terms above..

9. Gift and Offer Code

At intervals, Swecha’s Angadi may provide eligible consumers with “gift codes” or “offer codes” through diverse promotional efforts and communications, collectively denoted as “Offer Codes.” These codes can be redeemed for purchasing products on the site, subject to availability, and specific merchandise exclusions or other restrictions as determined and communicated by Swecha’s Angadi at its sole discretion. Only Offer Codes officially provided or endorsed by Swecha’s Angadi will be acknowledged during checkout. Offer Codes promoted by unauthorized third parties, including any unauthorized third-party websites, will not be deemed valid.

Each Offer Code endorsed by Swecha’s Angadi is non-transferable and valid for a single use on merchandise covered by Swecha’s Angadi. When making online purchases, the code must be entered in the ‘offer code’ field at checkout, as Offer Codes are exclusively valid online and not in showrooms or stores. Swecha’s Angadi disclaims responsibility for corrupted codes or any unauthorized use. Offer Codes hold no cash value and cannot be exchanged for cash or any equivalent, with no substitutions or credits allowed. Expiry dates may apply to each Offer Code, rendering them void if copied, transferred, sold, exchanged, or expired, and in locations where prohibited. Requests not adhering to all Offer Code requirements will not be honored.

About spokespersons, Swecha’s Angadi may occasionally involve individuals like spokespeople, influencers, bloggers, or entities who have received compensation or incentives to represent the brand. If you receive an Offer Code through a third-party source, such as a television or radio show host or any other media, be aware that these individuals may have been compensated by Swecha’s Angadi for their statements, and you waive any claims against them.

10. FeedBack

We value feedback from our users and encourage your comments about the Site. However, please note that if you submit creative ideas, suggestions, inventions, or materials (“Creative Ideas”), we will

(a)possess exclusive rights to the Creative Ideas, whether currently known or discovered later;

(b) not be bound by any confidentiality obligations and bear no liability for the use or disclosure of the Creative Ideas; and

(c) have the right to utilize the Creative Ideas without any restrictions for any purpose, whether commercial or otherwise, without providing compensation to you or any other party.

11. Content You Submit To Swecha’s Angadi 

From time to time, Swecha’s Angadi may allow you to post reviews, comments, photos, or similar materials on the Site (collectively, “Reviews”). We welcome your comments regarding our Products and services, including our Site. However, any Reviews you submit to Swecha’s Angadi must not harass, slander, malign, libel, defame, illegally threaten Swecha’s Angadi, or otherwise violate any rights of any third parties and must not include any profanity, obscene, indecent, pornographic, defamatory or unlawful material.

By posting a Review on the Site, you hereby grant Swecha’s Angadi an unrestricted, assignable, sublicensable, perpetual royalty-free, fully paid-up license throughout the world to reproduce, distribute, publicly display, transmit, communicate to the public, publicly perform on a through-to-the-audience basis, create derivative works from and otherwise use and exploit (collectively, “Use”) all Reviews you post to the Site, for any purpose, including promoting and marketing swecha’s Angadi and the Products. You further grant Swecha’s Angadi a royalty-free license to Use the name, image, and likeness of any person identifiable in any Review you post to the Site. By posting a Review, you waive any and all rights of publicity, privacy, or any other rights of a similar nature, in addition to any moral rights you may have in your Review. Except for materials provided to you by Swecha’s Angadi through the Site, you represent, warrant, and covenant that

(a) you are the sole and exclusive owner of Reviews that you post to the site, or you have all rights, licenses, consents, and releases that are necessary to grant to Swecha’s Angadi the rights in your Reviews as contemplated under the Terms, and

(b) The reviews you post to the Site do not (i) infringe, misappropriate, or violate the rights of any party or entity, including a third party’s patent, copyright, trademark, trade secret, moral rights, rights of publicity, rights of privacy, or other intellectual property or proprietary rights, (ii) constitute or result in defamation, libel, slander, or the violation of any applicable law or regulation (including, without limitation, restrictions on obscenity, child pornography, wiretap laws or other similar restrictions on nonconsensual recording, or otherwise), or(iii) require Swecha’s Angadi to obtain any licenses from or make any payments in any amounts to any third party throughout the world.

No  Objectionable Content:

You commit to refraining from submitting Reviews that:

(a) could be construed as infringing, defamatory, libelous, inaccurate, unlawful, harmful, threatening, abusive, harassing, vulgar, offensive, obscene, pornographic, objectionable, hateful, or endorsing discrimination, bigotry, racism, or hatred, as determined solely by Swecha’s Angadi applying reasonable societal norms; or

(b) introduce viruses, time bombs, worms, cancel bots, Trojan Horses, and/or other harmful or malicious code.

Monitoring:

Swecha’s Angadi is not obligated to monitor this Site or any part of it. However, we retain the right to assess any Reviews and, at our sole discretion, remove, delete, redact, or otherwise modify such Reviews at any time and without notice or further obligation to you. Wakefit is not obliged to showcase or publish any Reviews. Swecha’s Angadi, in accordance with our Privacy Policy, reserves the right to disclose any information or posted content it deems necessary or appropriate, at any time and periodically, including, but not limited to, meeting legal obligations, regulatory requirements, contractual obligations, legal dispute processes, or governmental requests.

12. Use of The Site

You are required to utilize the Site solely for its designated purpose and must adhere to all privacy, data protection, intellectual property, and other relevant laws. The following activities on the Site are prohibited unless authorized by us through an agreement:

Attempting to interfere with, harm, reverse engineer, steal from or gain unauthorized access to the Site, user accounts, or the technology and equipment supporting the Site. Framing or linking to the Site without permission. Employing data mining, robots, or other data-gathering devices on or through the Site. Posting incomplete, false, or misleading information, impersonating another person, or misrepresenting your affiliation with a person or entity. Disclosing personal information about another person, harassing, abusing, or posting objectionable material. Selling, transferring, or assigning any of your rights to use the Site to a third party without our express written consent. Posting advertising or marketing links or content, except as specifically allowed by these Terms. Utilizing the Site in an illegal manner or committing an illegal act in relation to the Site, resulting in fines, penalties, and other liabilities for Swecha’s Angadi or others. Accessing the Site from a jurisdiction where it is illegal or unauthorized.

13. DISCLAIMER

We do not assert or assure the accuracy, truthfulness, or reliability of content posted by third parties. You acknowledge that relying on material from third-party service providers is done at your own risk. By using the Site, you acknowledge the potential exposure to content that may be objectionable or inappropriate. We reserve the right to change, suspend, or discontinue any aspect of the Site, including hours of operation or availability, without notice or liability.

User Disputes:

We are not liable for disputes or disagreements between you and any third party you engage with on the Site. You assume all risks associated with dealings with third parties and agree to resolve disputes directly with the other party. You expressly release Swecha’s Angadi from all claims, demands, and damages in disputes among users, including yourself, and agree not to involve us in such disputes. Exercise caution and use common sense when using the Site.

Content Accuracy:

We make no representations regarding the accuracy, reliability, completeness, or timeliness of any content on the Site or data from third-party service providers. Similarly, we make no representations about the quality or nature of third-party products or services obtained through the Services. Use the Site at your own risk. We make no promises and disclaim all liability for specific results from the use of the Site.

You explicitly understand and agree that:

(a) Your use of the services is at your sole risk, provided on an “as is” and “as available” basis, and the released parties expressly disclaim all warranties, whether express or implied, including but not limited to, warranties as to products or services listed on the site, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

(b) The Released Parties make no warranty that (i) the Site will meet your requirements, (ii) the Site will be uninterrupted, timely, secure, or error-free, (iii) the results obtained from the use of the Site will be accurate or reliable, (iv) the quality of any goods or services available on the Site will meet your expectations, or (v) any errors on the site will be corrected; and

(c) Any material downloaded or obtained through the use of the Site is accessed at your discretion and risk and you will be solely responsible for any damage to your computer system or mobile device resulting from the use of such material.

15. Liability

You explicitly acknowledge and agree that the Released Parties will not be held liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for the loss of profits, goodwill, use, data, or other intangible losses (even if Swecha’s Angadi has been informed of the possibility of such damages). These damages may result from:

(a) the use or inability to use the site;

(b) the cost of procuring substitute goods and services resulting from any goods, data, information, or services obtained, messages received, or transactions entered into through, from, or as a result of the site.

(c) unauthorized access to or alteration of your transmissions or data;

(d) statements or conduct of any user or third party on the site;

(e) your reliance on content made available by us; or

(f) any other matter relating to the site.

To the fullest extent permitted by law, the maximum liability of the Released Parties arising from or in connection with the Site or your use of Swecha’s Angadi content, regardless of the cause of action (whether in contract, tort, breach of warranty, or otherwise), will not exceed INR 1000/- (Rupees Thousand only).

We will not be deemed to be in breach of contract or of these Terms due to any delay in our performance or failure to perform our obligations if that delay or failure to perform is caused by any circumstance beyond our reasonable control, including, but not limited to, fire, flood, acts of God, epidemics, pandemics (including the Covid-19 pandemic), strikes, riots, accidents, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, or road traffic problems.

You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, actions, or demands, including, without limitation, reasonable legal and accounting fees, alleging or resulting from

(a) your use of or reliance on any third-party content,

(b) your use of or reliance on any Swecha’s Angadi Content, or

(c) your breach of these Terms. We will promptly notify you of any such claim, suit, or proceeding.

16. Dispute Resolution 

The governing laws for these Terms and the association between you and Swecha’s Angadi will be those of Karnataka, India, disregarding any conflict of law provisions. Both you and Swecha’s Angadi consent to the exclusive jurisdiction of the Courts in Bangalore for any disputes concerning your use of the Site.

17. Termination

Regardless of any provisions in these Terms, we retain the right, at our sole discretion and without notice or associated liability, to terminate your license for using this Site. We also reserve the right to block or prevent future access and use of this Site for any reason or without providing a reason. Even after termination, these Terms will remain in effect.

18. We Reserve The Right To Update and Revise These Terms at Any Time
